Terms and Conditions for Participation in Workshops
By registering for a workshop with Roam Wild LLC DBA Roaming Wild Adventures and Nichole Vild, you acknowledge and accept the following terms, including the assumption of inherent risks associated with travel and outdoor activities. These terms serve as a full release of liability for Roam Wild LLC, its officers, contractors, and associates, as well as a complete assumption of risks by you, your heirs, executors, successors, and assigns.
Acknowledgment of Risk
Travel and photography workshops, regardless of location or transportation method, inherently involve risks of injury, illness, death, or damage to personal property. Such risks may arise from acts of nature, negligence, or the actions of others.
By participating, you agree to release Roam Wild LLC, its contractors, and associates from any and all claims, liabilities, and damages—whether mental, physical, known, or unknown—associated with your participation in activities, programs, and events.
Assumption of Additional Risks
Workshops may take place in remote, rugged, or wilderness areas with conditions that differ from those to which you may be accustomed. These environments may include:
- Mountainous terrain, wilderness, deserts, or wild rivers.
- Trails, roads, or accommodations that may not meet typical maintenance standards.
- Exposure to natural forces, wild animals, or extreme weather conditions.
Medical services may not always be accessible, and Roam Wild LLC assumes no responsibility for providing or facilitating medical care. By participating, you agree to assume these additional risks voluntarily.
Additional Waivers and Documentation
National Park and Other Regulatory Requirements:
Participants may be required to sign additional waivers or acknowledgments of risk as mandated by national parks, governmental agencies, or other authorities overseeing the locations we visit. Specifically, you will be required to sign a Visitor Acknowledgment of Risk form in accordance with National Park Guidelines.
Failure to complete and sign these documents may result in your inability to participate in certain activities or portions of the workshop, without refund or compensation.
Eligibility and Participant Expectations
Participants must:
1. Be at least 18 years old unless accompanied by a parent or legal guardian.
2. Be in good physical health and select activities appropriate to their abilities.
3. Inform the workshop leader of any physical limitations that may require accommodation.
Behavior and Preparation:
- You are responsible for reviewing pre-trip materials, bringing appropriate clothing and equipment, and acting in consideration of other participants and the environment.
- The workshop leader reserves the right to deny or terminate participation if your actions, health, or preparedness negatively impact the group's experience. Any associated costs will be your sole responsibility.
Flexibility and Group Dynamics
Travel with a group requires compromise. While itineraries are carefully planned, changes may occur due to weather, safety, or logistical concerns. Participants must allow for adjustments to timing, locations, and activities as deemed necessary by the workshop leader. No refunds or discounts will be provided for activities affected by such circumstances.
Cancellation and Refund Policy
If you need to cancel, written notice must be provided. Refunds are subject to the following conditions:
- More than 61 days before the workshop start date: Workshop fees will be refunded minus the deposit.
- 60 days or fewer before the workshop start date: No refunds will be issued.
Refunds will be processed using the same payment method. No exceptions will be made, including for medical emergencies.
Arbitration
All disputes or claims related to your participation must be resolved through binding arbitration under the American Arbitration Association's rules. Arbitration will take place in Tennessee, and you waive your right to trial by judge or jury. Any arbitration award may be entered as a judgment in a court of competent jurisdiction.
Media and Promotion
We reserve the right to photograph or film workshop activities for promotional use in print and digital media. By participating, you agree to allow your likeness to be used unless you let the workshop leader know beforehand. Written reviews or shared behind-the-scenes content may also be used for promotional purposes.
Insurance
We strongly recommend purchasing travel insurance to cover unexpected events such as trip cancellation, delays, medical emergencies, and baggage loss.
Third-Party Services
We rely on third-party providers (e.g., accommodations, transportation, and dining services) for certain workshop components. Roam Wild LLC is not liable for errors, cancellations, delays, or other unforeseen issues caused by these providers.
Participants should allow flexibility in their schedules for potential changes caused by such issues. No refunds will be issued for disruptions resulting from third-party services.
Acceptance of Terms
By registering for a workshop, you confirm your understanding and agreement with these terms and accept full responsibility for your participation. Roam Wild LLC DBA Roaming Wild Adventures and Nichole Vild reserve the right to amend these terms at any time without prior notice.
